四川将建企业海外知识产权维权援助平台

为提高企业知识产权保护能力，维护企业在海外的知识产权合法权益，护航我省企业参与国际竞争，四川省知识产权局、省工商局、省版权局、商务厅联合制定出台《关于企业海外知识产权维权援助平台建设工作方案》，助力省内企业开展海外知识产权维权。　

　　中国加入WTO以后，越来越多的企业积极地参与到国际竞争中，由于国内企业知识产权保护意识比较薄弱，涉外知识产权纠纷逐年增长。十八大以来，我省企业积极开拓海外市场，知识产权海外维权援助平台建设迫在眉睫。针对全省相关企业海外知识产权维权现状及需求，四川省知识产权局开展了相关课题研究。按照政府指导与企业参与相结合以及统筹兼顾、共同服务、突出重点的原则，此次出台的《关于企业海外知识产权维权援助平台建设工作方案》，将充分发挥政府在企业海外知识产权维权中的指导、服务和推动作用，由政府部门、行业组织、企业和国内外专业机构共同参与，针对不同地区、不同产业发展特点，制定专项维权援助措施。　

　　《方案》分为总体思路、基本原则、工作措施、工作保障、时间进度五个部分。为夯实企业海外知识产权维权援助基础，《方案》提出，我省将建立企业海外知识产权维权信息系统，优化企业知识产权海外布局，推动产业知识产权联盟、知识产权池建设，搭建企业海外知识产权维权服务网络。　

　　根据《方案》要求，四川省将建立功能较完备的企业海外知识产权维权援助平台，该平台应当具备培训、服务、协调、预警“四大功能板块”。其中在培训平台建设方面，将根据培训计划需要，组建由政府部门、企业、专业服务机构和高校的知识产权专家组成的海外知识产权维权培训团队，为企业拓展海外市场、应对知识产权海外纠纷，开展具有针对性的培训；维权服务平台建设方面，将根据企业需求，由专业服务机构为企业拓展海外市场、开展海外经营活动提供常态化的海外知识产权法律咨询服务，同时还将为企业提供知识产权海外侵权责任保险等服务；协调平台建设方面，将加强企业海外知识产权维权工作协调，推动多部门共同参与的知识产权海外维权信息系统平稳运行，加强和促进行业之间、企业之间和专业服务机构之间的协调；预警平台建设方面，将建立有关知识产权保护预警的数据库和服务平台。

The Sichuan Intellectual Property Office, the Provincial Administration for Industry and Commerce, the Provincial Copyright Bureau and the Department of Commerce jointly formulated the Program for Constructing Overseas Protection Assistance Platform regarding to Intellectual Property Right for Enterprises (the “Program “ thereafter), as to improve the protection of intellectual property rights (IPR) of enterprises, to safeguard legitimate rights and interests in concern of IPR overseas and to encourage the enterprises in Sichuan to participate in international competition.

After China's accession to the WTO, more and more enterprises have actively involved in international competition. However, the awareness of intellectual property protection of domestic enterprises is comparatively weak, foreign-related IP disputes have increased yearly. The enterprises in Sichuan have actively explored overseas markets since the 18th National Party Congress, the construction of IPR overseas protection assistance platform seems to be imminent. In view of the current status and needs of enterprises to protect IPR abroad, the Sichuan Intellectual Property Office has carried out related research projects. In accordance with the principle of combining government guidance with business participation and taking into consideration of the principle of co-ordination, common services and emphasis, the “Program” plays a significant role in the government’s guidance, services and promotion for enterprises regarding IPR overseas. Government agencies, industry organizations, companies and professional organizations at home and abroad take apart in the development of special rights protection, measuring for different regions and industries.

The “Program” is divided into five parts: Overall Thinking, Basic Principles, Work Measures, Job Ensuring and Time Progress. To consolidate the foundation of IPR protection overseas for enterprises, an information system is set up to optimize the overseas distribution of corporate intellectual property, to promote the development of IPR alliances, to construct the intellectual property pools and to build overseas IPR protection service network.

A fully functional enterprise overseas IPR protection assistance platform is completed according to the “Program”, with consisting of "Four Functional Blocks”: Training, Service, Coordination and Early Warning. On the aspect of Training, an overseas IPR training team composed of government departments, enterprises, professional service agencies and universities’ intellectual property experts and counsels is organized to expand overseas markets for enterprises, to deal with overseas intellectual property disputes and to carry out targeted training; on the aspect of Service, professional service agencies provide customized and normalized overseas IPR legal advisory services for enterprises whose needs are to expand markets and conduct business activities abroad, IPR overseas infringement liability insurance simultaneously; on the aspect of Coordination, coordination is strengthened on the overseas IPR protection of enterprises, smooth operation of IPR overseas protection information system with multi-sector, inter-industry, inter-enterprise and professional coordination between service agencies is promoted; on the aspect of Early Warning construction, a database and service platform for early warning of intellectual property protection shall be established.
